The Huddle Nation (thehuddlenation.com) respects the intellectual property rights of content creators, photographers, and copyright owners. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which may be found on the U.S. Copyright Office website, we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our Site by submitting a formal DMCA Notice of Alleged Infringement as outlined below.

How to File a DMCA Notice of Alleged Infringement

If you believe that your copyrighted work has been copied, reproduced, or used on our website in a way that constitutes copyright infringement, please provide our Designated Copyright Agent with a written communication containing the following information:

  1. Identification of the Copyrighted Work: A detailed description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notice, you may provide a representative list.

  2. Identification of the Infringing Material: The exact URL or location on thehuddlenation.com where the allegedly infringing material is located so that we can find and remove it. (Please provide the exact web page link; a general site description is insufficient).

  3. Your Contact Information: Your full legal name, physical mailing address, telephone number, and email address.

  4. Good Faith Statement: A statement by you that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.

  5. Statement of Accuracy under Penalty of Perjury: A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner’s behalf.

  6. Your Signature: A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner.

Please note: Under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material or activity is infringing may be subject to liability for damages, including legal costs and attorney fees.

Counter-Notification Process

If your content was removed or access to it was disabled due to a DMCA notice, and you believe this was the result of a mistake or misidentification, you have the right to file a Counter-Notification.

To be effective, your Counter-Notification must be a written communication sent to our Designated Agent containing:

  • Your physical or electronic signature.

  • Identification of the material that has been removed and the location where it appeared before removal.

  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  • Your name, address, and telephone number, along with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Wyoming, USA, if your address is outside the United States), and that you will accept service of process from the person who provided the original DMCA notification.

Upon receipt of a valid Counter-Notification, we may forward it to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider, the removed material may be replaced or access to it restored within 10 to 14 business hours after receipt of the counter-notice.

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, The Huddle Nation maintains a policy of terminating, in appropriate circumstances and at our sole discretion, users, contributors, or commenters who are deemed to be repeat infringers of intellectual property rights.
